Sofia Vergara to Pay Ex-Fiancé an Estimated $79,392

The star of Modern Family, Sofia Vergara, was recently ordered by a judge from Los Angeles to pay her former partner Nicholas Loeb an amount which adds up to $79,392.26, which consisted of attorney fees ($76,433) and other costs ($2,959.26) during their legal battle.

It was the actress’ ex-fiancé, Nicholas Loeb, who filed the motion for attorney fees in June 2019 wherein he sought to acquire $117,590.87 in attorney fees and another $2,958.26 in cost after his alleged success in his anti-SLAPP motion for it related to a particular claim and prosecution which he considered “malicious”.

Vergara, on the other hand, argued that the said motion should be denied for the fees and costs which were being asked as they were not related to the anti-SLAPP motion following its success. She further added that Loeb’s motion was in a way “heavily reduced”.

The formerly engaged couple had been openly discussing possibilities of having a child via in-vitro fertilization and a surrogate parent in 2013. In the same year, Vergara and Loeb visited the ART Reproductive Center in order to undergo an IVF procedure wherein both parties were made to sign an agreement which stated that none of either participants could utilize the cryopreserved material without written consent from the other.

Moreover, the two pre-embryos that were created were in ART’s cryogenic storage where they remain at present. After the couple split in 2014, Loeb had been trying to gain full custody of the two embryos. Meanwhile, the star of Modern Family, who is currently married to Joe Manganiello, argued that such action from Loeb is violating their signed agreement regarding the uses of the embryos. The two parties have carried on legal battles on this case and other aspects of it.

In the meantime, the court determined after the evaluation of billing of records and declarations that the fees sought by Loeb are not justified by the record and this resulted in the reduction in the supposed fee award of 35 percent. The court also added that there is no alternative method in calculating fee award that would provide accurate results. However, Sofia Vergara is still expected to make the payment within 30 days.
